Trademark Policy

This policy outlines how Kambi Group plc, and its subsidiaries (“Kambi” or “we” or “our” shall be construed accordingly) addresses claims of trade mark violations.

A trade mark is a word, slogan, symbol, or design — like a brand name or logo — that a person or company uses to distinguish their products or services from those offered by others. Generally, trade mark law prevents others from using a trade mark in an unauthorised or confusing manner.

Please note that trade mark law generally does not prevent others from using your company or product name in their writing — even if the writing is negative or critical — so long as it does not confuse people about the source of a good or service. For example, a negative review of your product is likely not an infringement of your trade mark.

If you believe someone is using your trade mark on our mobile applications, websites, channels, facilities or services in a way that is likely to confuse people about the source of a goods or service, and you are the trade mark holder or their authorized representative (e.g., a legal representative or other representative for a brand), you can report the alleged violation by providing us with:

  • The trade mark holder’s name, address, and website;
  • The trade marked word/symbol in question, and the category of goods and/or services in which you are asserting rights;
  • The trade mark registration number and country where you claim trade mark rights;
  • Information that allows us to find the infringing material on Kambi (e.g. a link to a post, reply, network, or user);
  • Explain what the problem is: How your trade mark is being infringed and what’s causing the confusion (be specific please);
  • Explain what you want us to do: for example, remove a certain post, or ask a user to change their name or user profile in some way;
  • A statement that:
    • You are authorized to act on behalf of the trade mark holder;
    • You believe in good faith that this third-party use of the trade mark which you are telling us about has not been authorized by the trade mark owner;
    • You have concluded in good faith after careful review that the use of the trade mark is not fair use;
    • The information in your notice is accurate;
    • You understand that in order to process this report, Kambi may provide third parties with a copy of this complaint.
  • Your contact information, including your mailing address, telephone number, and email; and
  • If you are not the rightsholder, explain your relationship to the rightsholder (e.g., an authorised representative, such as a law firm or marketing company).

If appropriate, and in our sole discretion, we will respond by acting, e.g. removing a post, reply, network, or edit blocking, or banning a user.
